If you’ve decided to seek protection under the bankruptcy laws, one of the first things you’ll discover—there’s no shortage of bankruptcy lawyers willing to take your case. So how do you find the right person to guide you through bankruptcy and get a fresh financial start? Here’s a checklist to help you protect yourself.
Ask the Important Questions
With any legal counsel, it all boils down to three primary concerns:
- Does the attorney have the skill and experience to effectively resolve your problem?
- How responsive will the attorney be when you have questions or concerns?
- How much will it cost to complete the bankruptcy filing?
As with anything, it’s difficult to know if you’re getting what you need unless you look at a few options. At a minimum, you should talk to at least three lawyers, asking all of them the same questions:
- How much experience do you have? How many years have you been in practice and how many bankruptcies have you handled? What percentage of your practice is devoted to bankruptcy filings? Is it a significant focus of your practice?
- What types of bankruptcy proceedings have you handled? Do you represent consumers and businesses?
- How many cases do you handle at any given time? What kind of staff do you have to assist you?
- What will the total cost be for the bankruptcy filing? Is it a flat fee or will you bill by the hour? What will you do for me in exchange for the fees paid? What types of payment do you accept (cash, credit card, check, etc.)?
